I. General sales conditions and delivery terms
1. Validity of conditions
The following conditions are valid for all our deliveries, services and offers. They apply solely. Any purchaser's terms and agreements being contrary or deviant to our conditions will only take effect by a special written confirmation from our side.
2. Offer and contract conclusion
a) All our offers are without engagement and subject to change. The purchase order is a binding offer. If the order is placed online, we will directly confirm its entry by E-mail. This receipt only confirms the incoming of the customer's order and still represents no order acceptation. Since we are entitled to accept the order within two weeks by sending an order confirmation or the goods requested.
b) We reserve the right of alterations and modifications for deliveries and services - especially due to construction and product changes - as far as they will be reasonable for the customer.
3. Time of delivery
Our common delivery time is two weeks. Forwarding will be carried out by UPS, DHL or Hermes. If the delivery item has to be manufactured according to customer specification or after checking technical questions, delivery time starts with the appointed date on the end of production. If a delivery is made impossible by circumstances we can't account for, we shall be entitled to withdraw from the contract.
4. Prices and forwarding charges
a) Prices
All our prices are quoted inclusive of V.A.T. being valid as per time of delivery. Quotations are made without engagement and are subject to change. Additionally incurring delivery expenses and forwarding charges as well as third party expenses (C.O.D. charge of forwarding company) will be indicated separately (cf. below b).
b) Forwarding expenses and C.O.D. charges
The customer bears the expenses for delivery and shipment. Forwarding charges depend on the kind of shipment, method of payment, weight and destination. Details for calculating the amount of forwarding expenses are shown on our websites. Before the costumer's definite purchase order the precisely incurring forwarding charges will be indicated in line with the order transaction and be invoiced separately. The forwarding expenses apply for shipping inland and within the EU. A shipment outside the EU will only be carried out after a special agreement. The forwarding charges will be communicated within that scope.
If partial deliveries are caused or offered by us the subsequent deliveries will be carried out free of shipping costs. In case of special customer requests for a delivery splitting the forwarding expenses for each partial delivery will be additionally charged.
An additional fee will be charged for orders being sent by cash on delivery. These costs are also mentioned on our websites and will be indicated separately at the order.
5. Terms of payment
All payments become payable without any deductions immediately after issue of invoice. A payment can be made by credit card, cash on delivery, PayPal or payment in advance. For cash on delivery a separate C.O.D. charge must be paid to the corresponding forwarding company. In case of prepayment, payment by PayPal or bank transfer the shipment will not be made until irrevocable credit entry. For credit card payment the card will be charged directly before forwarding the goods.
6. Retention of title
We reserve the right to repossess the delivered goods until complete payment of the price.
7. Liability for defects (warranty)
The legal regulations of warranty apply for all defects on the sales item occurring within the legal statutory limitation.
8. Instruction of return
- Right of return:
You may return the received products within two weeks by sending the goods back without stating reasons. The period begins after receipt of a written instruction (e.g. letter, fax, E-Mail), however not before the goods' arrival at the recipient (for periodic delivery of similar products not before the first partial delivery's entry) and also not before fulfilling our duties to furnish information corresponding § 312e Abs. 1 Satz 1 BGB in conjunction with § 3 BGB-InfoV as well as our duties according to § 312e Abs. 1 Satz 1 BGB in conjunction with § 3 BGB-InfoV. Only for products not being transportable in parcels (bulky goods) you can also express your demand for return in writing. Sending the goods or the demand for return just in time will do for keeping the deadline. In any case the return will be made at our expense and risk. In case of demand for return the goods will be picked up at your place.
- Consequences of return:
If a return takes effect, services already being received on both sides and possible utilisations (e.g. compensation for use) must be refunded. Value compensation can be claimed for deteriorated goods. This does not apply for deteriorations only caused by product examination that would be possible in a shop or so. Besides, you can avoid the obligatory compensation for loss value by not using the goods as if they were your property and omitting all that might reduce their value. Payments have to be refunded within 30 days. Your deadline begins by sending the goods or demand for return, ours with the receipt.
9. Governing law/jurisdiction
Contractual language is German. For the contractual relationship to our customer German law will be applied only. Application of the standard UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. Unless regulations from other legal systems are subject to contrary agreement according to international conflicts of law being valid in Germany, these will remain unaffected.
If the customer is a merchant, our business location will be place of jurisdiction. However, we are entitled to proceed against the client as well at his domicile.
II. Privacy policy
We record the required information for order processing and, if necessary, pass it to companies being involved in the transaction (UPS or DHL). Of course, we treat all personal customer data as strictly confidential. Further details for privacy and data protection can be recalled on our websites.
